Since 2000, our firm has proudly represented injured workers in the New York Workers' Compensation System. Last week, the Board submitted a "proposal" which would decimate benefits for tens of thousands of men and women injured in the course of employment. This would result in little to no financial compensation for horrific injuries causing permanent physical impairment. This is being pursued despite the fact that Workers' Compensation costs in New York are already at the lowest rate in years and still falling. Thus, these cuts in benefits do little for business premium rates, and can be devastating for injured workers.

Imagine an injury on the job results in a total knee replacement, forcing you to receive a fraction of your wages for six months while trying to recover, and having to live with a permanent injury, all to be told by the State Workers' Compensation Board that your injury has resulted in no permanent damage, thus you will not recover the balance of your lost pay. Workers' Compensation is not a welfare program, despite what insurance companies would have people believe. It is an insurance program that was created as a bargain in exchange for workers giving up their right to sue their employers in civil court after an accident. The continual attack on benefits in other states has lead to state constitutional challenges and litigation of the legality of the system.
